Acceptance of terms

By accessing or using Rampart (“Service”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. TerraSecure LLC (“TerraSecure”, “we”, “us”) may update these terms from time to time, and the updated terms will be effective upon posting.

Authorized use

Rampart is designed for authorized security awareness training and phishing simulation. You may only send simulations and training to people who are employees, contractors, or otherwise authorized representatives of your organization. You must obtain any legally required consent before sending simulated phishing messages.

Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. Organization administrators are responsible for accurate user lists, appropriate content, and compliance with applicable laws.

Prohibited conduct

You may not use Rampart to: harvest credentials from unauthorized individuals; send deceptive messages outside your organization without consent; distribute malware; violate intellectual property rights; harass individuals; or attempt to reverse engineer, scrape, or disrupt the Service.

Data and privacy

Our collection and use of personal data is described in the Privacy Policy. You represent that you have the right to upload contact and directory information for your users and that doing so complies with your internal policies and applicable privacy laws.

Intellectual property

Rampart, its logos, training content, and software are owned by TerraSecure or its licensors and are protected by copyright, trademark, and other laws. You receive a limited, non-exclusive license to use the Service during your subscription.

Disclaimer of warranties

The Service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the Service will prevent all security incidents or that simulations will be indistinguishable to every recipient.

Limitation of liability

To the maximum extent permitted by law, TerraSecure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Termination

Either party may terminate a subscription in accordance with the plan terms. We may suspend or terminate access for violations of these terms. Upon termination, your data may be retained for a limited period as described in our Privacy Policy and then deleted.

Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Disputes will be resolved in the courts located in Maricopa County, Arizona.
